A Behavior Emergency Report (BER) is the written record California law requires whenever an emergency intervention (e.g., physical restraint or seclusion) is used with a student, or when serious property damage occurs. It documents what happened, who was involved, what led to the behavior, and what staff did in response. California Education Code §§ 49005–49006 and § 56521.1 establish when a BER is required, what it must contain, who must receive a copy and how quickly, the IEP team follow-up that must occur, and the restraint and seclusion data LEAs must report to the state.
